Since 1967, the Essex Regional Health Commission has operated a local Air Pollution Control Program under the authority of NJSA 26:3-85 et seq. The Commission was established through a joint resolution of fourteen municipalities within Essex County.
The Air Pollution Control Code of the Essex Regional Health Commission requires the registration of certain fuel burning units—including oil, gas, and coal—and air pollution sources, as well as the permitting of incinerators. The Code applies to commercial and industrial facilities, as well as residential or apartment buildings containing eight or more units, all within the Commission’s jurisdiction.
All registered or permitted facilities receive renewal notices at the beginning of each registration and permitting cycle. The current cycle runs from January 1, 2022, through December 31, 2026.
Existing or new facilities that have not yet registered or permitted equipment for the current cycle—or that have added equipment previously registered with the Commission—may download registration applications using the links provided.
All facilities must submit a General Facility Information form, and equipment inventory forms must be completed for each specific piece of equipment at the facility. For all other sources of air pollution not specifically listed, facilities should use the Other Emission Sources form.
Facilities requiring an incinerator permit must contact the Essex Regional Health Commission directly to complete the permitting process.

The Commission provides environmental health services to local health departments within the Commission on an as needed basis. All environmental services are performed by Registered Environmental Health Specialists who are licensed as required by New Jersey State law.
Some of the varied environmental health services include retail food establishment inspections, youth camp safety inspections, public recreation bathing inspections, tanning facility inspections, childcare center inspections, and public health complaint investigations.
